Terms of Service
These Terms of Service (“Terms”) govern your access to and use of deadpost(“deadpost”, “we”, “us”), a cron and heartbeat monitoring service that is independently operated and provided on a best-effort basis. By creating an account or using the service, you agree to these Terms. If you don’t agree, please don’t use deadpost.
1. The service
deadpost lets you register monitors that expect a periodic “ping” from your scheduled jobs, and notifies you when an expected ping doesn’t arrive in time. Alerts are delivered on a best-effort basis and depend on factors outside our control — your network, third-party email providers, notification channels, and the timing of your jobs. deadpost is a safety net, not a guarantee. Do not rely on it as your sole safeguard for anything where a missed or delayed alert could cause serious harm.
2. Accounts and eligibility
- You must be at least 16 years old (or the age of digital consent where you live) to use deadpost.
- You’re responsible for the accuracy of your account information and for keeping your credentials secure.
- You’re responsible for all activity that happens under your account.
- Notify us promptly if you suspect unauthorized use of your account.
3. Acceptable use
You agree not to:
- Use deadpost for any unlawful purpose or to violate the rights of others.
- Abuse, overload, disrupt, or attempt to gain unauthorized access to the service or its infrastructure.
- Circumvent rate limits, quotas, or access controls, or probe for vulnerabilities without our written permission.
- Use alerts or any notification feature to send spam, harassment, or other unwanted messages.
- Resell or provide the service to third parties except as expressly permitted by your plan.
We may suspend or terminate accounts that violate these rules, with or without notice where the violation is serious.
4. Plans, billing, and refunds
deadpost offers a free tier and paid plans. Paid plans are billed in advance through our payment provider and renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change plan pricing or features with reasonable advance notice.
5. Your data
You retain ownership of the data you put into deadpost (monitor configurations, workspace details, and the ping data your jobs send). You grant us the limited rights needed to host and process that data to provide the service. Our handling of personal data is described in our Privacy Policy.
6. Availability and changes
deadpost is offered “as available”. We may modify, suspend, or discontinue features, and we perform maintenance that can cause temporary downtime. The free tier carries no uptime commitment. The product is under active development and may change as it matures.
7. Disclaimer of warranties
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that alerts will always be detected or delivered on time. You are responsible for maintaining your own backups and redundant safeguards for anything critical.
8. Limitation of liability
To the maximum extent permitted by law, deadpost will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the service — including any missed, delayed, or undelivered alert. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve (12) months before the event giving rise to the claim, or USD 50, whichever is greater.
9. Indemnification
You agree to indemnify and hold deadpost harmless from claims, damages, and expenses arising out of your misuse of the service or your violation of these Terms or applicable law.
10. Termination
You may stop using deadpost and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the service to you poses a security or operational risk. Sections that by their nature should survive termination (including Disclaimer, Limitation of Liability, and Indemnification) will survive.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date and, where appropriate, notify you. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which deadpost is operated, without regard to conflict-of-laws rules. Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence.
